10. Accessibility Compliance (United States Clients Only)

1. Scope of Accessibility Work

The Developer will build the website using the Wix or SquareSpace platform and will apply standard industry best practices and the tools available within Wix or SquareSpace (including running an Accessibility Wizard if available) to support accessibility where reasonably practicable.

Unless otherwise agreed in writing, the Developer’s services do not include a formal accessibility audit, custom remediation to achieve full ADA or WCAG 2.1 AA compliance, or ongoing monitoring after project completion.

2. Client Responsibility

The Client acknowledges that legal compliance with the Americans with Disabilities Act (ADA), WCAG guidelines, or any other accessibility legislation is the sole responsibility of the Client.

Because accessibility can be affected by future content updates, third-party integrations, and changes in legal standards, the Client is responsible for testing, monitoring, and maintaining accessibility on an ongoing basis.

3. Optional Accessibility Services

If requested in writing, the Developer can provide additional accessibility services (such as third-party audits, remediation, or testing) for an additional fee to be agreed upon in a separate Statement of Work.

4. Limitation of Liability

The Developer shall not be liable for any claims, losses, damages, or legal actions arising from the website’s actual or alleged failure to comply with the ADA, WCAG, or any other accessibility regulations or standards.
